H1b Cap Exempt Criterion

Hi,

Employer X filed my H1B case 3 years back. The case is still "Case Received". I have I-797. The same employer X does not exists. Now Is the case fall under Cap exempt ? Can some other employer take it from here and file for transfer ?

Yes your new employer can claim cap exemption.
