  • Have H4 .. Can I shift to H1 to another employer?

    Hi All ...

I'm on H4 visa, but have my H1b approved in 2008 quota for employer X.

Can I now activate my H1b and work for employer Y != X?

In other words, when I have an H1b approved for one employer but never activated, can I activate it and use to work for another employer?

Pls let me know ... Thanks a lot!

PS - I came to US on F2 visa, converted to H4 when my husband moved to H1b.

Your new employer has to file for a H1b COS for you using the approval notice from X and wait till it is approved for you to work for Y.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Thanks for your reply ..! I understand the new employer can directly convert me to H1 without any payslips requirement (I never worked for that matter).

My question is: does the old employer have any control over the H1b? Can he do something to it, like cancelling? I'm confused about the terms H1b cancellation and reactivation without a brand new H1b filing.

Pls let me know . Thanks a lot!
