    Hi all,

    My husband is in USA on H1B. we recently got married.
    He was on bench from past 4months and recently he got a new job. April 5th is his joining date.
    When visa interviwer asks for paystubs can i produce 4months back paystubs nd recent job 1 paystub. Iam planning to go to USA by may 1st week so should attend the visa interview in april mid. by april mid he will get 1 paystub of recent job. is it suffiecient. can u please suggest me on this matter.

    Legally he should get paid whatever time he is in US on H1b.
    The visa officer can ask for atleast 2 to 3 paystubs. So, if VO asks for paystubs and you will have only 1 recent, then they will issue 221g. And that will create a problem for you, your spouse and may be for his company also.

    The best thing is, before going for h4, wait for his recent 2-3 paystubs.

      When you are in H1B, you need to get paid. There is no such thing as "bench" when you are in H1B. If not now, this will cause issues later. The W2 will reflect a lesser wage compared to the LCA and the future extensions, stamping and GC can become an issue.
