  • Changing from L1B to H1B

Hi, I am a new user and this is my very first post to immihelp.com. If anyone could help me out on the following queries, it would be really great. Sorry if the query is repeated.

I was working in US on L1-B through the Company A from Jun 2005 to Feb 2008. I applied for H1B through Company B (Small Desi consultant in US) in Apr 2007 and got the I-797. But I neither Changed my Visa nor Joined Company B. I went back to india and was working for the same company A. Again I have come back to US on L1-B (Jun 2009) through the same company ( Company A). Now my question is

    1) Am I eligible to use the H1B now which i got in 2007 ?
    2) If so, Do I need to work only for the company B which processed my H1B?
    3) Can I join other company with out leaving US using the H1B which Company B processed ( is H1B transfer possible with out joining Company B) ?

I would really appreciate if you could reply asap!!!

    Thanks

    1) Am I eligible to use the H1B now which i got in 2007 ?
    >>> Yes. Provided that H1B approval notice is still valid (check the expiry date on the petition).

    2) If so, Do I need to work only for the company B which processed my H1B?
    >>> No. You can apply for a transfer.

    3) Can I join other company with out leaving US using the H1B which Company B processed ( is H1B transfer possible with out joining Company B) ?
    >>> Possible, if that petition is still valid.
Not a legal advice. Use of this information is strictly at your own risk.
