  • H1 Extension

    Hi,

This is my situation, hope someone gives me information.

1.Initially my H1 visa was set to expire on Dec 31, 2009.My employer filed extension for me and received approval for extension in Dec, 2009.The extension is for 1 year till Dec 31, 2010.
2.In mid of January I came to come to India due to family emergency.
3.In feb 2nd week, my employer received a notice from USCIS saying that they could not locate my client location. Looks like USCIS tried to physically visit
my client location for verification and they could not locate the office. Becuase of this they asked supporting evidence documents giving the all details of my client site address etc.And unfortunately my approved H1 turned into a query now.
    3. My employer in mid of Feb sent all the supporting documenets which would help USCIS.
4.USCIS are yet to come back to us.
    5. Iam still in India. Now my question is, If I go stamping in India with the originally approved petition , will the stamping be successful or will they issue query?

Please let me know your thoughts.

    Thanks

Very hard to predict. I don't think you have any other option other than going for a stamping in case your existing visa has already expired. I would suggest you to strongly to carry all the required documents (Client letter, proper LCA, employment verification letter, project related documents etc).
Not a legal advice. Use of this information is strictly at your own risk.

      Hi Shervin,

thanks for the reply. Yes my visa was expired in dec 2009.
I have all the documents which you mentioned and any other documents which they would ask, but its just they if they see current petition i wonder what they say? if they check online in their system they will come to know that the current state of petition has query..
