  • H1 transfer, payroll and travel

Hello. I have some questions on my H1b transfer and travel.

My previous H1b visa was valid and stamped till 09/30/2021.

    1. On 07/12/2019, I left my clientA and got my last paystub from my employerA on 08/05/2019( for pay period 07/01/2019 -07/15/2019).

I was on bench since 07/13 to 08/26 (new LCA filed by new employerB and sent the H1 transfer docs along with the last paystub of 08/05 to USCIS on 09/04). Based on receipt, I started working at new clientB from 09/12 and received my first paystub through the employerB on 09/28/19. Currently I am waiting for H1b transfer approval. Will there be any chance that I was on outofstatus during my bench period and cause H1b transfer denial/RFE?

    2. For say I received I797 approval without any discrepancies till 09/2020. I am planning to travel to India on 11/15/2019. Do I need to re-stamp again on my passport even though I had visa stamp till 2021?

    3. My wife is on H4 visa and her passport got stamped till 2021(my old H1 date). She is travelling to India this month and planning to comeback to US in Dec2019. Does she need to re-stamp passport again to show my latest H1 status?

    1. Grace period is 60 days so you are good as long as it's less than that.
    2. You don't need a new stamp but carry your documents tied to your new employer.
    3. Not sure about H4 but it should be same with 2.
