  • H1B layoff and visa status

    Dear sir/madam,

    I have completed about three and half years of visa period of the total
    6yrs. My petition got extended with current employer on 2008 and valid till
    2011. Unfortunately got laidoff in May 2009.

    I tried changing my H1B to new employer but they wanted me to bear the cost
    of transfer. Looking at the future job scenario for H1B I could not
    confidently go forward. I moved back to india closing all my financial
    dealings in 15days time.

    Question:
    Is my H1B still valid as i am having still 3 yrs of visa time in it?
    Should I need to apply for new H1B when come to US?
    Can the new employer in india consider my H1B for any onsite job?

    I have been a contact reader of your Q&A's and are very helpful. You are the
    only people who can really clear this tricky questions by looking into legal
    aspects.

    1. Your H1B is no longer valid. You can still utilized rest of the years on
    H1B provided someone files new petition for you.
    2. Yes.
    3. Again, your previous H1B is no longer valid .
