For Cap Counted H1B

Hello Members,

I have a question about cap counted H1B v/s fresh H1B.

I worked on H1B for 3 and half years and currently on H4 status. Once I find a job and the new employer wishes to process my H1B and convert me from H4 to H1B Status, do they need to file a new H1B for me or they can apply against my previous H1B cap since I have not exhausted the 6 year limit. Your advice is appreciated. Thanks

Can apply for H1b cap. No need for fresh h1b.
