  • Can a new Employer apply for H1 without the knowledge of any previous H1.

I am currently in US on L1b working for a client(G) and my employer is (S).
I have an approved H1 from an independent consultant (C) but I do not have any documents. The US client now wants to hire me and I do not want to go to the consultant to ask for my H1 documents, because of the bond and other stuff. Can the US client file the H1 without knowing this fact? Is there any way I can get my H1 visa documents from the consultant so that i can just transfer the H1 visa instead of applying for new. Please suggest. thanks in advance

Your client can file a new H1B. They don't have to knw about the previous H1B approval. For H1b transfer, you need the receipt number from the previous H1B approval notice (or better if you have a copy of it).
