Am I cap exempted?

Hi I have an H1 Petition valid till sep 2010. I have not yet stamped it or never travelled on it or never used it. I would like to know whether I am cap exempted? If yes till when I am cap exempted? If the same employer of some other employer want to file a new petition after the expiry can they do it without cap? Please note that I have not stamped it yet or never used once

You can transfer it before the petition expiry without having to go through the CAP again. After the expiry, you will need to file a new petition.
