H1B After 6 Yrs

Hi, Here is my case:
6 yr limit will end on Nov 2010
I will leave the country in Sep 2010

Can I appy for a fresh H1 in 2011 and come back in Oct 2011 ?
Since my next yr visa petition only allows me to work after Oct 2011 would that not suffice to meet the one year limit for stay outside country?

When your new H1B petition is taken for processing, you should have spent 1 year outside U.S.
