Hi,
I have couple of questions on activating my dormant H1B CAP petition. Currently, I am on my L1B visa valid up to Aug 2022 but my H1B petition(Consular processing in India) is expiring on Jan 3rd 2021. Also, Me and my wife are expecting a 2nd baby sometime at the end of September this year(Due to this, travelling overseas can be done only either in 5th Month of her pregnancy or Post delivery after September).
In regarding to this,

- What is the best time for me to go to India for activating my H1B petition. Considering my new born will get his/her Birth Certificate/SSN/US Passport/OCA and other related documents to travel to India in time and I come back and apply for my H1B extension before its expiry? (My company can do H1B extension up on my arrival in premium)
- Or can I activate H1B even after its expiry?
