    Hello,
    I changed companies back in december 2009 and at the time my new company applied for an h1-b transfer. We got a receipt notice in january 2010

    I am working at a client site through the company that applied for my h1-b transfer and the client is willing to sponsor for an h1-b directly. I spoke to an immigration lawyer who said that there is something called a change of petitioner form. I am wondering whether it will make sense/be possible to fill out this change of petitioner form so that the h1-b petitioner name can be changed from the company that applied for my h1-b transfer in december to the client company I have been working at?

    It is the same process what you did before. The client now has to initiate a H1B transfer. Just give them a copy of your existing H1B approval notice and they should be able to apply for a transfer.

      Well, that is the issue. I haven't received an approval notice yet. Just a receipt notice. Given that, can I still do a change in petitioner or will there be a problem?

        Hi, I too have the same question. I would like to change my job even before the H1 i-797 is in my hands. Is it possible to apply for a transfer in such case?? Also, If my current employer doesnt cancel my H1 petition, what would be the chances that he will give me a soft copy of the i-797 form to me?? Thanks in Anticipation..

          >>> The term transfer applies only when you already have the H1B approved by USCIS. With just the filing receipt number, you cannot initiate a transfer. In this case, ask your new employer to file a fresh H1B petition (they are almost the same). However, if the H1B petition is approved, then you can transfer it with just the receipt notice.
