Hi All,

I am currently on H4 Visa valid till Feb 2011. My husband has to go to India for 3 months from september to November. My baby is due in August end and there are high chances I will not be in favorable conditions to fly with him with a newborn.

Can I stay without him in US on medical grounds as my doctor can provide a letter saying that I can not fly? If yes is there a specific period for which I can stay?

Only short trip by the primary applicant outside the country without the dependents are allowed by USCIS. 3 months is a long time and you will be out of status without the primary applicant.

One alternative is to file for a COS to B1/B2. Otherwise you should consult an immigration attorney to see if there is any other possibility.
