    Hi friends,

    Could anyone please guide me in the below situation that i have:

    Am Visiting India and returning to US one week(on 5/18) before the H1 stamp on my passport gets expired(on 5/25). The stamp that i have on passport is from Company A. However, I already switched to Company B and have active H1 visa untill 2011. In this situation should i get my stamping done during this visit or i can return to US without issues with my new visa being active.

    I have heard they look for three months window before visa gets expired but my visa is actually not getting expired. Just the stamp through earlier company is getting expired.

    Please reply so i have a clear picture...

    You can re-enter as long as the visa remains valid. By showing the approval notice from the new company, you can get an I-94 until the petition expiry. This is the normal procedure. However, some officers at the POE will give you an I-94 only till the visa expiry date (happens very rarely). In which case, you will have to file for an extension again before that I-94 expires.
