    H1 Extension

    Hi,

    I need some advice. I do have h1b visa till Dec 2011. Another firm bought our firm. They are planning to file h1 extension for me. They had requested certified LCA's. We have not received it from DOL yet. But i must home this week for marriage.
    Can they file my h1 extension when i am out of country and send me approved i797 at home? Can i file H4 for my wife on old petition.
    I appreciate help from you.

    Extension of status cannot be filed while a person is out of the country. Petition can be filed without an extension. Meaning, the petition will get approved as a consular process (without new I-94) and you will have to get it stamped.
