Hi All,
My wife situation:
1. She is on H4 currently in usa
2. She has a valid approved H1 when she was in india, but she came to usa on H4 1st time, and in between she travelled to india and came back on H4. - meaning until now she never used H1 yet.
Question:
1. Can she apply change of status from H4 to H1,
2. if yes for above question, is it amendment, if it is amendment can we apply premium process?
3.If so,will she get a valid I-94 here only or doe she need to go out of country ?
4. if we dont get valid I-94 and need to go out of country, can she withdraw and continue on H4 (this is because we dont want her to travel to india now for visa)
