  • H1 Transfer with Premium processing

    Hi i work for company A on H1b visa
    i got a new job with company b.
    Company B is willing to do H1b visa transfer

    My understanding is that normal Visa transfer process takes around 2 to 3 months.
    Also until i get my I-797 (approval or rejection i cant work for company B)

    Question-
    1. If Company B does my H1b visa transfer in Premium processing ,
    DOES THAT MEAN I WILL GET MY I-797 APPROVAL OR REJECTION IN 15 days???

    is this understanding correct?
    (i do have idea that if company b applies under normal processing , after i get my receipt of fess paid and document i can work for company B,
    )

    Q2- But what if after 2/3 months this I797 comes with Rejection?

    Q3. in that case can i go back and work for Company A?? (If H1b visa transfer is rejected)

    1. Decision is taken in 15 days. It might be little late to get approval/rej notice.
    correct.
    2. You have to leave the company
    3. Yes, if your old employer didn't revoke H1.

      another question:

      Q1. When you say decision is taken in 15 days, does that mean with my Fees Receipt and Case number in 15 days i can see that if Petition is Approved or Rejected???

      Q2. If through case number i can see that H1b is approved, i can wait for little longer to receive that i-797b approval in Postal Mail.
