Who all are going to get the benefit of Aug 13 H1B visa relaxation rule?

Need to visit India for a family emergency. My husband needs to get his H1B visa stamped. He has received his visa extension approval. Will he gets the benefit under the August 13 relaxation rule that says “ If you are working with the same employer in a same position in which you were working earlier under the same visa category” you will get your visa stamped. He is working in Telecomm. sector.
