  • Converting to preminum processing after H1 petition is filed

    Hi,

    H1B petition is filed for me by my employer about a month back . I know that its is going to take more 60 days to get the visa stamped .
    But as per some urgent requirement i need to get the visa in short time .

    Could i now convert my visa petition into premium now ?

    You are confusing between visa and petition. If I understand you correctly, I believe that your employer filed an H1B petition on your behalf and you would like to convert into into premium processing now. If the question was, whether you can convert it into premium now, then the answer is yes.

      Yes, your understanding was right .

      I know that it costs $ 1000 for premium procesing .
      I know how to opt for premium processing before the petition got filed .
      But whats the procedure to opt for premium processing after the petition got filed ..?
      And even though i opt for preminum processing , would i be able to start working before october 1st ?

        You just have to file the premium processing form mentioning the petition receipt number. Your employer has to do it since it is their petition and they will know how to do it.

            Is this your fresh H1B or you applying a new H1B using an existing CAP? If this is your fresh H1B, then you cannot work until Oct 1st (Until the effective date in the approval notice for that matter).

              Its a new H1B petition .

              Even though am opting for normal petition i would get it before oct 1st.

              so, in that case i guess premium processing would not be helpful to me .
              Plz correct me if i was worng .

                Yeah! Premium will not be of much help in your case. There is enough time to get the approval via normal process and that would save your employer $1000.
