  • L-1B to H-1B consular processing

    Hi,
    I am on L-1B visa in US currently. I got picked in the second round of H-1B lottery in August.
    Here is my situation:
    • My employer filed H-1B petition for consular processing.
    • My L-1B visa (first 3 years) is valid till mid 2022

    Consulates are not giving out new work visas until Dec-31 2020 (atleast). I am trying to understand my options if the visa ban is extended.
    • How long do I have after petition approval to get H-1B visa stamp ?
    • If I am not able to get H-1B stamp, can my L-1B visa be extended in 2022 for another 2 years ?

    Answer: You can get visa stamp any time during your H1B Approval period.
    If I am not able to get H-1B stamp, can my L-1B visa be extended in 2022 for another 2 years ?
    Answer: Yes. You can. Please note, until you go for visa stamping and get visa stamped on H1B, your current status will not be changed. Therefore, if you want to continue with L1 then Yes, You can do.
