H4 to H1B COS

I was issued a H1B visa in 2009...In Jan 2010 I travelled to the US on an H4 visa.

Now the same employer is applying for a COS from H4 to H1B....will the COS be for a new H1B....and more importantly if yes, then if the COS is approved will I be able to start work right away (since I had an H1B earlier too) or will I be able to start work only Oct 2010 onwards?

Once COS from h4 to h1 approved, you can start working. No need to wait till october.
