    Hello,

    I had an H1B from 10/01/2013 to 09/16/2016 and was working for a consulting company from 10/01/2013 to 03/31/2014, later due to personal reasons I quit my job and unable to stay in the h1b visa, so moved to dependent H4 visa. So, I have hardly used my h1b i.e. only 6months and now I'm working on an H4 EAD and due to current potential delays on the H4/EAD, I'm thinking to reinstate my old h1b since it would be a cap-exempt.

    So, I have the below questions.

    1. Can I reinstate the old h1b with a new sponsor? will there be any expiration on the cap-exempt?

    Answer: If you were on H1B status within 6 years and you have unused H1B in your account then you will be eligible for filing H1B petition to use remaining period and it will be considered as CAP exempt.
