I am a J-1 research scholar, and subject to the 2-year home residency requirement, and I am trying to apply for a new H1B visa. I read the rule that the 2-year requirement will not begin until the exchange visitor has completed the program and departed the US. I have departed the US over a year ago; however, my DS2019 is still active now. Assuming that I ask for my J-1 status to be terminated now, would the one year that I have already spend in my home country count towards fulfilling the 2-year requirement?
