  • Visa Appointment Question

    Hello Sir/Madam,

I have some confusion while looking up/booking the dates for my visa stamping. Attached is the screen shot.

There is a question stated as follows:

Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*

    Yes/No?

My initial H1-B visa expired on 15th Jan, 2009 (which was valid from 15th Jan, 2006) and it has then been renewed until 22nd April, 2011 (valid I-797). I have not got my visa stamped after it was renewed. I plan to do that during my visit (for my marriage) to India in September, 2010. I also plan to get my wife's first time H4 visa stamped.

With all this in mind, what should be my answer to the above question? Yes/No?

Appreciate your response in regards to this.

      Hi OP,

Correct me if I am wrong.

You are saying your latest/last H1 VISA on the passport expired in JAN'2009.

You have new approved I-797 valid till 2011.

If that's the case , then answer should be "NO" , because your H1 Visa is not valid when you go for stamping in SEP'2010 and also it is expired for more than 12 months.

      Thanks and Regards,
      Abhay
