  • H1 Extension - RFE - Medical reasons

    Hi,
    My company applied for H1 extension and we got an RFE. The RFE has been replied with all the information. The decision for RFE will take around 60 days. My I-94 will expire in another 30 days. My wife is pregenant and she cant travel for another 40 days. In worst case scenario if the extension is rejected, we have to go back. However my wife cant travel, is there a provision for medical grounds for temporary extension.

    Please advise. Can I do a premium processing now? Is premium processing risky?

    You should go for premium. If your extension is denied, then you cannot apply for any other status change as well, as your current I-94 would have been already expired by then. You stay past the I-94 expiry will be considered illegal and you will endup having to leave the country immediately.
