My H1B WP is till 22-Aug-2010. My I-94 is till 01-Sep-2010. H1B Extn applied.Options?

My H1B WP is till 22-Aug-2010. My I-94 is till 01-Sep-2010. Which is valid? H1B visa date or I-94 date?
My H1B extension was filed on May 12, 2010. Almost 3 months have already passed i.e. 13 weeks over and I have not yet received the approval notice. I have checked the same in the USCIS website and it says it's still under initial review.

Can I stay beyond 22-Aug OR 01-Sep since I have not received any extension till now. Please let me know.

Both dates are valid. H1 date is for working. I-94 date for staying. Immigration officers sometimes give I-94 date later than H1 expiry date.

If extn denied, your stay becomes illegal, else fine.

Just wait for USCIS response. If petition approved and extn denied, you can reenter with a new H1 visa.
