Hello to all:
Me and my wife just moved from OK to CA. My wife went to the DMV office to update the address in Driver's License.
My wife came as H4 and now she is in H1B status.
Her old Passport and Visa (H4), Surname is her father's name.
After she came to US, she changed the surname. Her new passport has the new surname and her form I-797A (H1B status) also has the new surname. Even her OK driver license has the new surname.
But we were told in the DMV office that they will go with the name whatever is specified in the visa, which in our case is the old surname. We told them that visa in the passport is H4, expired and the surname was changed after coming to America and all the new documents reflect the new surname.
But they sticked to their point. They suggested to go out of the country to get the new visa in the passport with the new surname only then they can given the driver license in the new surname.
How can I deal with this situation without going out of the country?
