H1 to H4 pending..need to apply for H1b

H1 to H4 is in pending and need to Apply for H1 transfer

After i took opinion from Lawyer, I understood that we can file H1 transfer with H4 receipt Number while H4 is in pending.

But the new employer is not accepting it and he says that his attorney is not allowed.

How to proove/show this to new Employer. So that he can file H1 Transfer with H4 pending receipt number.

Can i provide any Uscis guidance document?

Please suggest. it is very important for me
