    I lived in the US from Jan 2000 to Aug 2009.I had come via H1B and got Green card via my employer in 2005. Due for family emergency ( my mother serious state of health) i had to stay back in India. I had to give up my green card and in 2014 when i had applied for US B1/B2 Visa ( at that time I handed over my Green card to a Consular officer at Chennai Embassy).

    SInce then I have travelled 3 times to the US via B1/B2. I have 2 kids. Both are US citizens and one of them is i grade 10 now was to pursue undergrad in the US. For that I need to come to the US to work.

    Please let me know
    if there is ways to show the intent for my kid to study and request USCIS to renew my green card as they are US citizen.

    If NOT

    Can i try transfer of my old H1B ( 2003) petition as i had 1-140 status cleared document ( during my old green card processing )

    Or Do i need to apply for Fresh H1B

    Please let me know what options to i have

    Hi,
    If you prefer H1B then you will need to apply under H1B CAP QUOTA..

      Thanks for your reply , so the only way is H1B cap quota is it. so i guess H1B transfer not an option?
