  • H4 visa Issue for my kid

    Hi All

    I am on H1b Visa. My husband is on H4B. I came to US in Sept 2009. When I came here my husband change his Status H1 to H4. My daughter has h4 Visa in her passport on my husband H1b. His H1B is expired in Sept 2009. Before expiration date my daughter attended for H4 visa on my H1b along with my brother.

    Because I and my husband we both are in US. My daughter is 5 yrs old when she attend for Visa. She is in India along with my parents now. When she attend for visa, the visa office given a white form and he written "to attend with any one of the parent".

    My Question is :--

    Is it compulsory to go to India me or my husband. Actually my in-laws got visiting visa. so they are coming to US. So I am planning to attend her for visa along with my Inlaws. Is that ok. Please give me your Suggestion.

    Hi ,

    This is my view:

    although its not MANDATORY/RULE that for Minor Visa-Parents should be there.But it is always advisable to do so

    So now as the VO has given the white sheet that one of you should be present and if they have it in their records/system , then next time also when your child goes with inlaws , they MAY suggest the same.

    There are lot of reasons that why Parent should go with a minor,some are:
    (a) How VO will know that Parents are ready to support the child/Parents want that child should come to US- as Child Visa is H4 (dependent)
    (b) Sometimes even if one parent goes - VO sometimes asks for the notarized approval letter from other parent also-to make sure that parents together going to support the child/approves/No objection for the visa.

    Below is the FAQ from US India Visa site:

    My child needs a visa. Do my wife and I have to attend the visa interview with our child?
    Yes. Both parents should attend the visa interview with their child if possible. Where one parent is unable to attend the visa interview with the child, the absent parent should provide a letter to their wife or husband that states they have no objection to the child’s application for a visa.

      I am not getting vacation in my job. I can send my husband, but the problem is he has stamped H1b visa in his passport. He don't have W2s for 2008. Since last year Sept 2009 he is in H4 visa. There may be a chance to ask about his h1 details like W2s. That is the reason we are not daring.

      Can I Provide any letter for my kid to attend with her grandparents.

      Please suggest me.

        If the 221g is issued especialy for a parent to be present, then I don't thing there is any other alternative. The VO seems very particular that at least one of the parent should be present and this information will be recorded in their system.

            My daughter got this attached Query.

            So Is it compulsory to go for her visa I or my husband.

            I came to US in 2009 sept. I got SSN in Oct. I got job in Feb 2010. So I don't have 2009 W2. I think If I or my husband go for visa, there may be a problem with W2 right.

            That is the reason I am planning her to attend with my in-laws. they already have visiting Visa.

            Please any one give me solution for this.

            I'll wait for your valuable suggestions.

              It clearly states that she must be accompanied by one of the parents. If parents already have a Visa they need not apply, just accompany. If Visa is required for both, it is up to you to decide whose Visa application is 'safe'.

                Hi OP,

                As mentioned - one of you has to go if you want that Visa should be stamped for your daughter (without that you are just taking the chance..outcome of which nobody can predict...)

                So If you and your husband have the valid visa's then VO generally will not ask many questions related to your Visa/husband visa- as you are accompanying your daughter for her visa.
                But as your daughter is just 5 yr old...so obviously..VO will not ask many questions to her and hence chances are more that Visa will be stamped.

                If your husband is going then keep in mind that VO may ask your husband abt ur job/company (as you are on H1 and rest are dependent on you-H4).
                So VO may ask for your I-797 (Original) and employment verification letter-stating that you are working for YYYY company , YYYY postition and earning YYYY salary for your daughter H4 visa.

                As per my view - Chances are very less that VO will ask for W2-forms of you -for your daughter H4 visa.
                So , if you send your husband along with other necessary doucments required for your daughter H4 visa (mentioned in immihelp list)then I say chances are 99.99%...
                (sorry cannot say 100% ....)

                  [email protected]"

                  Is this get any problem to me. Did consulate people trace about my details. why they ask about my and my husband location. In mail I clearly mention that we are in US. I was scared when I saw this mail.

                  Is everything ok. Did I get any problem to my visa also.

                          Provide clear details as requested by the consulate. Have somebody proof read your emails/letters to the consulate. You seem to have some trouble communicating in written english that a VO might have concerns about how you are working on a H1b.

                          Also, they may be wondering if your husband fell out of status before changing over to H4. Many issues. Unless you send them details of all documentation clearly explaining the documents, they may not be in a position to process the visa.

                          If your physical location is in US, mention it.

                              Thankyou for your response.

                              Finally my daughter got het H4 visa. She attended for visa along with my In-laws. They already have visiting visa. VO interviewed my daughter and asked some formal question.
