  • L1 to H1 COS

    Hi,

I am on l1 status and another employer is ready to file h1b for me through the COS process.

The new employer says I can start working for them as soon as they get the receipt notice, provided the start date is after oct 1.

My understanding is that only if I get the Approval notice before Oct 1, I will be authorized to work after oct 1.

Can experts please brief the process and let me know at which point I am authorized to work for the new employer?

    Thanks.

You are authorized to work only when the COS gets approved. The effective start date will be in the approved petition. Until the COS gets approved, you will still remain in L1 status and your employment with H1B employer will be considered illegal.

Let your employer know that he is not a lawyer and consult with one than misguide people.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
