H1 approved - h4 extension pending

Hi I got my H1 approved for this year and it starts on Oct 1,2010. Also my H4 expired on sept4,2010 and my husband's employer applied for his and my extension on July15,2010. My status is still in initial review. I'm planning to withdraw my h4 extension if I don't get my extension before oct1,2010.Can any one let me know the h4 extension withdrawal procedure? Will it affect my husband's h1 extension and how long will the process take?

It was wrong to apply for extension, when H1 change of status was already approved. Now, if H4 extension is approved, your status will be H4 and you will not be able to work from Oct 1. The petition will remain valid. If that happens you will have to travel outiside, get H1 visa and enter in that status in order to work.

Hi ,

I had to apply for extension because I will be out of status from september 4 to 30. Inorder to avoid the out of status issue i applied it long back. But still its pending, So any idea how to apply for h4 extension withdrawal?

Send a plain paper letter to the same service center where you sent your I-539. Mention the receipt number for I-539 in the letter.
