  • Change of employment, H4 biometric

    Hi,

We are currently in USA. My husband is on H1, we dependents on H4 (wife and child). Now my husband is changing from employer A to employer B for a new job. So the new employer B is processing the H1 COE (Change of employer) in H1 Premium Processing.

If H-4 applications (I-539) are being filed for dependent(s), note that biometric (fingerprint) appointments are required for all I-539 applicants, regardless of age. Dependent(s) will receive biometric appointment notices shortly after filing. Now as per the USCIS website it has been mentioned USCIS Temporarily Suspends Biometrics Requirement for Certain Form I-539 Applicants effective May 17, 2021. So is this applicable in this scenario?

Appreciate it if anyone can help us with this.

    Thank you,
    Amrita.

      Hi,
If you are going to file H4 petition now, then you don't require biometrics as USCIS has suspended. You can just file the petition along with H1B petition (if possible) and wait for the status.
For more details about suspension of biometrics, you can visit immihelp blog. Below is the link for the same.
Temporary suspension of biometric requirement for certain nonimmigrant applicants that would like to change or extend nonimmigrant status in the U.S.

      Thanks
