[FONT=Times New Roman]I came to the US in Dec 2003 on a h-4 visa that is valid till August 2006.
After coming to the US, I had my h-1 filed through an employer and got the approval in August 2004. I have a h-1 approval (I-797)valid from October 1st of 2004 till September 2007.
I have been on bench right from October and don't have a job till now.
So I do not have any pay stubs and W2 forms.
Hence i did not get the h1 stamped on my passport. My passport still has the h4 stamp on it.
I might have to go to India as there is a medical emergency at home. To visit India and again come back to US, i might have to get the h1 stamped on my passport. As i do not have the pay stubs and w2 forms, i don't think i can do that.
What is the best course of action that i can take?
Can i revert back to my h-4 status?
If so, what should i do to revert back to h-4 status? Also, Can i enter US with the current h4 stamp?
I would really appreciate if any one of you can help me by providing more information.
