  • How and when should i ask my employer to apply H1b (or GC?) for me?

    I recently started working at a startup about 3 months ago after graduation. I am on an OPT visa. I feel like i would have done a good amount of work by December. Is that a good time to ask my employer if they can apply a H1b? (They have applied for other employees before). Or is that timeline too late?

    What about directly asking them for an EB2 GC application? Am i jumping the boat by asking for that? Technically they can apply for it, or should i ask it only if i fail to get the lottery? 192.168.0.1

    Answer: If your Employer is ready to sponsor H1B then you can move forward any time. Your Employer can target sponsoring H1B for next year.

    Answer: I am not recommending filing GC when you are on Student status. As you well aware, F1 is single intent. During these time, if you have travel plan or when you try for getting admission in University, your GC application may impact on these things. Better you consider GC when you are on H1B status.
