H4 Extension Rejection

I filed my H4 extension before I-94 expiry date. I got the mail saying my application was rejected due to improper filing. My I-94 was already expired when I received the rejection in mail. Has anyone had this issue? My questions are.
1. How can I ask for the H-4 extension start date from I-94 expiry date while refiling my I-539 so that there will not be any gap?

Answer: You will have to refile as soon as possible and wait how USCIS reacts on your case. What my hope is, as you mentioned, petition is improper filing, you may argue to get the petition accepted when you refile. But, in this case you will need surely Immigration Attorney help.
On another hand, Its better to leave the country and get the H4 visa stamped at consulate to avoid any future issues.
