  • H1B Stamping Eligibility In CANADA

    Hi All-
    I came to U.S in Oct,2009 on L1B and got converted to H1B in Mar,2010.
    My employer is asking me to go for stamping in Canada as in India lot of rejections are happening these days.
    My question is "Can I go to stamping in Canada as mine is Change of Status and also First time H1B"
    Please help me ASAP so that I can decide where to go.

    ---- Yes you can go to Canada for visa stamping whethter it is first time or any other condition

    ---- The issues are 1) They may not be able to verify your qualifications if you do not have a North American degree
    2) If you are given a 221g you may not be able to return to the US even if you have a valid visa
    3) You may be asked to go to your home country if the VO so feels

    ---- Espite all the rejctions/refusals/denials that you read on the forumsa dn hear form others there are people who have been successful in getting a visa stamp

    ---- After all you have to try adn find out. The chances are unpredictable and unforseen

      I got L1B stamped once...that means they have validated my degree correct?? So would you please correct me if my understanding is wrong??

        ---- If you have got your L1B visa processed in Canada it is good sign. But that does not hold good for every occasion and every type of visa including H1

        ---- Processing L1B does not reflect your credential evaluation. Both are different matters. At that time the VO might have been convinced about your qualifications and the overall interview

        ---- Thus, in my prveious post I had said that credential evaluation is one possibility and not a condition for granting a visa

        ---- This time when you go for H1B visa stamping hope you are successful in getting the H1 visa
