  • H4 holder and remote job

My wife has received an H1B visa and will be employed in the USA soon. Based on her H1B visa I have received an H4 visa. However, I have a job in a different country. My employer was okay to let me work remotely while I stay with my wife in the USA. I would receive a salary in my country of residence and would pay tax there as well. But, we received recent information which states that I am not allowed to work (even it is in a foreign country and even it is a remote job) while physically present in the USA. We have our flights booked and scheduled to fly soon, but we are now in a dire situation to make a decision. Any opinion from your side will be much appreciated. Thank you.

Indeed, absent an H-4 work authorization you're not allowed to do this. Once you reside and work substantially in the US, even for a foreign company, you owe US taxes (and in many states, state tax). This will put you into a status requiring an employment authroization.
