  • Travel to Canada on Approved I-797

    Hello All,

Can I travel to Canada if I have an approved I-797 but my visa is not yet stamped? I read you can travel to Canada and return back to US without a stamped visa on approved I-797 if the trip is less than 30 days. I am not sure if this applies for new H1 cases (I had a change of status from L1 to H1 in Oct 2021). Has anyone done this in recent times?

    Thanks.

Yes, you can enter the US on Automatic Revalidation, even if your visa is expired, or you had a different type of visa (in the case of people who did Change of Status), and be admitted until the expiration date of the I-94 on your previous stay, after a trip of less than 30 days to only Canada or Mexico.

This is my personal opinion and is not to be construed as legal advice.
