H1b rejected after 2 221g---L2?

Hi All,

Today chennai consulate rejected my H1b visa renewal under 221g after giving 2, 221g queries.

My wife is in US on L1, can i now apply for l2, I have to be there urgently as we are expecting our baby in December, please let me know can I go for L2 stamping and will my H1b rejection affect in any way.

---- Yes, you can apply for L2 visa and come to the US. It does not have any affect by H1B visa

---- Both the visas are independent of each other and each application will be considered on its own merit

My spouse is also in similar situation. He was in US for last four years and his h1b visa renewal got denied under 221g.
If he applies for L2 separately, how should he handle following question:
1. What will you do in US? Are you going to work there?

Also does the duration of stay in US (long/short) makes any difference?

If he applies for L2 separately, how should he handle following question:

1. What will you do in US? Are you going to work there?

---- Say yes to this questions and when the officer prompts an answer to this question say yes once You get the required authorization and a good job you will work there. It is an acceptable response as you can work on L2

Also does the duration of stay in US (long/short) makes any difference?

---- If it is for work purposes duration does not make any difference. You are going to work on L2 as long as the l1 is valid and renewed
