Can I make my kid as my dependent on H4 rather than my husband's dependent?

Hi, I recently got H1B approved. My husband is also on H1B. Me and my kid were on H4. After my H1B approval, we raised h4 withdraw request for me. As a result, I got both my and my kids H4 status "reopened". I came to know that if primary applicant's 539 withdrawn, it withdraws 539 A as well, Should I submit H4 request for my kid now as my dependent? Can this stop him being out of status?
