  • H1B: docs needed for stamping

    Guru's,

Are the following docs necessary for H1B stamping in case of direct employment? or these are need only in consulting employments?

    From Your Petitioner:
A copy of the petition with all supporting documents as filed with USCIS.
A copy of the employment contract or letter of agreement signed by you
    and the petitioner.

Petitioner’s Income Tax Return for the last two tax years and
    financial statements.

A notarized list of all the petitioner’s employees of the job site
listed. The list should show all employees’ names, their specific job
titles, start and end dates, and their individual salaries and
    immigration status.

State Unemployment Wage Reports, showing all wages paid to each
employee in the state, for the past three quarters. (This should be
the actual forms filed to the State authorities listing each employee
and wages paid during the quarter.)

    Thanks in Advance!

These documents are required for everyone who attend the visa interview. USCIS or the consulate doesn't differentiate in terms of the document between a consultancy firm and a non-consultancy firm. The only difference is that, if you are working for a consultancy firm, then you will need to provide letter from the client stating that you are working for them on so & so project.

If you company is not ready to hand over few of the confidential documents to you, then they can directly mail it to the consulate, if the consulate issue you a 221g requesting for these documents.
Not a legal advice. Use of this information is strictly at your own risk.

Thanks a lot Shervin. Appreciate the response.

Can the 221g's - yellow, green, blue happen to anyone at random?. I'm planning a trip and am concerned about getting stuck as my vacation won't be extended and work from home is not an option.

I have been on H1 since 2002 and just got a 3 year extension based on PERM pending and approved I-140.

      Please advise.

I have all the Docs EXCEPT:

Petitioner’s Income Tax Return for the last two tax years and
      financial statements.

A notarized list of all the petitioner’s employees of the job site
listed. The list should show all employees’ names, their specific job
titles, start and end dates, and their individual salaries and
      immigration status.

and wages paid during the quarter.)

Its not a random thing. They issue you an 221g only if they need to verify additional documents from you or if they need to go for an administrative process on your application.

Most people will not have the below listed documents when they go for the visa stamping, since they are confidential company documents. These documents are not checked very frequently unless the consulate has doubts about the company that you are working for. In case of a 221g for any of these documents, the company can directly sent it to the consulate.
