I have applied for H1 B in 2019 and my H1 B was approved for Mar 2020 to Dec 2020. But due to lockdown and covid my stamping was not done. Now in Jan 2023, I have applied for H1B Cap Exempt with my same employer. But they are refused to file the petition as there is no proof of travel and stamping on my old petition. Is there any such rule by USCIS for H1B Cap Exempt that if stamping and travel not done on previous petition then we are not eligible for H1 B Cap Exempt. Kindly guide me how I can proceed further or is there any alternate to use my old petition.
