  • Change of status - L1B to H1B - with Approved I140 on L1B

    Dear members,

I left USA before 1 month of H1B visa 6 yr maxout date and since then for 1+ years I am working from India. My current employer will be filing L1B visa and once in USA, also hoping to get I140 approved.

Towards the 5 year expiry to L1B -

    1) Can I do change of status to H1B from L1B capturing 1 month of time remaining from my earlier cap exempt H1B petition/status?
    2) And can I extend and continue to extend my H1B by 3 more years (after 5 years of L1B) using L1B approved I140?

    many thanks!

        1. Yes, you may be able to recapture any remaining time from your previous H1B petition/status towards your new H1B visa. This would depend on the specific circumstances of your case and you should consult with an immigration attorney echat to determine your eligibility.
        2. It may be possible to extend your H1B status beyond the six-year maximum if your employer has an approved I140 based on your L1B visa. Again, this would depend on the specific details of your omeglz case and it is recommended that you seek guidance from an experienced immigration attorney.
