  • VISA stamping before the current validity expired

    Hi All,

I have a valid visa stamped in my passport and it is going to expire on Jan 31st, 2011. I am going to india in december and i got the extension(I797) up to sept 2013. while coming to US i will have only 1 month visa left in my passport and i am thinking that will be a problem. So can i attend visa interview in this december before the current one expired? please prove some suggestions?

    Thanks.

Yes you can, although it is not necessary. If you travel before your current visa expiry date, then at the POE you can get an extended I-94 (Valid until Sept 2013) by showing both the current as well as the extended petitions.

Yes, it is better to get it stamped as you don't have to deal with transit issues on future travel.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Thanks txh1b. I am thinking the same.My consular district is Hyderabad. I have been looking in to vfs site for hyderabad dates but there haven't open anything in dec. I am planning to attend in Chennai. I think that is not a problem because i am currently staying in US.

Yes. A returning H1B worker can take an appointment at any U.S Consulate in India.
