  • Complicated H1B situation!!!

    Hi All,

    First, for the below complicated situation, I am the sole responsible guy!!!

    My Situation:

    1: Did MS in 2007, then worked on OPT and later CPT.

    2: Got H1B from Oct 2009 for employer YYYY ( of size 4 employees) but worked with on the best company onsite, I have all paystubs, W2 etc in proper order.

    3: Jun 2010, transffered to Employer YYY( of size 15 employees) and simultaneously got another oopurtunity with another company ZZZ (of size >10000).

    4: Had been to stampling in the month of Jul2010 with YYY but they have put on pending under 221g yellow from Hyderabad. Submitted all the documents requested on the form. It was taking lot of time, meanwhile got H1B from ZZZ, so withdrew YYY and freshly applied for ZZZ. During the withdrawl process, the USCIS people have visited YYY to confirm my job but by that time I withdrew YYY.

    5: Later, the consulate officer was confused and even put ZZZ under hold i.e. 221g and ZZZ didnt want to give any documents as it was a public listed company and were not willing to provide.

    6: Got fed up and confused with the situation, so withdrew all application and took up a job in India.

    Now, my client where I worked before has an offer for me to join in January.

    My Questions:

    1: Should I pick YYY and apply fresh (YYY has not revoked my visa)?

    2: Should I pick another new employer to sponsor?( Another employer is ready to sposor me but the consulate people had already expressed thier displeasure of me having mutilple H1B visas and looking from the angle of fraud but the fact is I never paid a single pie to any of the sponsorors, infact an Indian woman working in the consulate office made a sarcastic comment"Are you from IIT or what that so many employers are willing to sponsor". Well I consider it as a stereotypic comment )

    3: Do you guys have any better suggestion for me to go about?

    Your advice would be immesly helpful to my family and me?

      I dont think there is even a slightest bit of complexity here other than you imagining things. Having multiple sponsors is not an issue. Having proper documentation is the issue.

      Put the past behind you. Find a new sponsor or use the old company, submit client letters. Even if the old company has not revoked the H1b, the consulate usually recaptures the unused H1b that was withdrawn. It is better for any sponsor to apply for a fresh H1 for you.
