  • Labor for Greencard Processing

    Hi

I got my visa on OCT 2006 andI cam to US in APR 2007.
My question is, before what date I should apply for labor?

    Thanks,
    Sai

You can apply it any time. There is no such constraint. However, if you are on H1B and want to extend it beyond the 6th year, then you need to file the labor 365 days before the end of the 6th year on H1B.
Not a legal advice. Use of this information is strictly at your own risk.

---- You should apply for your labor certification at least 365 days before your H1 ends. If it is already 3 years since you have had a H1, then it is time to start applying the LC.

--- The preparation and documentation takes up a lot of time and that depends on you, the employer and the attorney

---- However, it all depends on you to initiate the process and convince your employer/attorney to apply for the LC and then follow it up
