Seeking consultation on a H4 EAD case
Hi,
My wife and I are from India. I am a resident alien in US on H1B while my wife arrived in US in December, 2022 on H4. Through my employer, we had filed for extension of my H1 and my wife's H4 visa and both got approved. We had also applied for my wife's H4 EAD card which got approved on 17th Feb, 2023. However, USCIS had asked for a new photograph on 2nd March for which my employer didn't reply and instead they had separately filed a service enquiry to USCIS on March 14th for reason for delay in EAD card issuance. USCIS had replied back on 31st March reminding my employer about the 2nd March notice. On April 11th, new photos were submitted as per specification. Due to this delay and non-action on original USCIS notice, I wanted to get legal opinion on whether we should simply wait, or escalate via Ombudsman or if there is an option to apply for a fresh issuance of EAD.
