  • H1b Withdrawal Request

Last year (2022), I filed my H1b application with employer XYZ, submitted all the required documents, and was informed that my application had been filed and was waiting for a response from the USCIS.

In September 2022, I was informed by my employer that my H1B packet had been returned, and there was nothing they could do to rectify the situation. They advised me to try again the following year.

I was disappointed but hopeful to get my H1B next year (2023). This year, I was selected by another employer for the H1B application. However, they informed me that my previous H1B application with XYZ was still pending, which was preventing them from filing my H1B application for this year.

I tried to track my H1B application's status on the USCIS website and found the following message: "On February 9, 2023, we began reviewing your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number ************. We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by February 23, 2023, contact the USCIS Contact Center at www.uscis.gov/contactcenter. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

I contacted employer XYZ to understand why my H1B application was still pending, given that they had informed me earlier that it was returned. While waiting for their response, I learned from internal sources that employer XYZ had filed my H1B application with their sister companies without my knowledge. This means that my H1B application was filed from multiple sister companies that belong to the same beneficiary/company.

As soon as I found out, I immediately sent an email to employer XYZ, requesting that they withdraw my H1B application even though it is in pending status. I am currently awaiting their response.

I am deeply concerned about the consequences I may face due to the multiple filings and what I need to do in this situation, given that I was unaware that my H1B application was filed with employer XYZ's sister companies. Any help and guidance would be greatly appreciated.

Thank you for your time and assistance.

    Sincerely,

    Ted
